Trip Hazards

Homeowner associations are responsible for repairing the common areas but are not obligated to repair trivial defects that may exist.

Defects in walkways are generally not considered trivial where the separation is 3/4 of an inch in depth and some courts may determine that even smaller differences in elevations constitute a dangerous condition. While concrete grinding may be utilized, there is no substitute for replacing elevated sections of walkways.

Holes in paved areas should always be repaired in order to avoid both trip hazards and additional damage to the paving.
